The purpose of this book is not only the study and analysis of the contentious-administrative process under the new Jurisdictional Law that has just been published (Law 29/1998, of July 13). The intention of the author is also to draw attention to three key issues of our jurisdictional system and, in my opinion, affect the rule of law. The first of these is the obsetion for converting any right and particular interest, whatever its condition and nature, into a fundamental right and, consequently, worthy of constitutional protection. This leads to a distortion of one"s own fundamental rights and to a permanent confrontation with the general interests that the Administration represents, as if particular interests were alien to public reason itself. The second issue, perhaps a consequence of the first, is the permanent attempt to reduce, even eliminate, the means and instruments that the Public Administrations need to fulfill their purposes. For this, in addition, an image of the same is promoted distorted and representative of inefficiency, arbitrariness and interventionism limitless and destructive of any scope or sphere of private action. Again, the confrontation between private interest and the public interest and the need, it is said, for judicial control of the Executive Branch (Administration and Government). (...)
